Gender critical belief is protected

The Employment Appeal Tribunal has held that the belief that an individual’s sex is fixed at birth and cannot be changed is a “protected belief” under the Equality Act 2010 (Forstater v CGD Europe and others UKEAT/0105/20).

The ruling means that a researcher who made comments on social media, including that trans women are men, can continue with her discrimination claim, which she brought after her employer failed to offer her further consultancy work or renew her visiting fellowship.
