Recognition
 claims fail on ballot rules


Public services unions PCS and UNISON have fallen foul of the strict statutory recognition rules by winning recognition ballots but failing to get sufficient numbers of workers to vote.


PCS had claimed collective bargaining rights on behalf of 484 workers at specialist digital technology services firm BPDTS. The Central Arbitration Committee (CAC) ordered a ballot, which saw over 77% of those returning ballot papers voting in favour of PCS recognition. However, that equated to only 36% of the bargaining unit voting in favour — just short of the 40% required by the rules.


UNISON’s bid for recognition at care home group Abbey Healthcare also failed, despite a ballot of workers resulting in an 87% vote in favour of recognition. Here the vote in favour was just 24% of the bargaining unit.
