EPSU Legal challenge


EPSU, the European public service union federation, has decided to challenge the refusal of the European Commission to transform a European-wide agreement between employers and unions in central government into binding legislation. 


The agreement extends rights to information and consultation, which are guaranteed through European legislation in the private sector, to those working in central government. 


Following its signature by unions and employers in December 2015, both sides asked the Commission to transform the agreement into legislation, the procedure provided for in the European treaties. However, in March 2018, after months of delay, the Commission stated that it would not do so. 


Faced with what it describes as a “flagrant disregard” for the autonomy of unions and employers, EPSU will now ask the European Court of Justice to rule on the Commission’s decision.
