Personal injury claims 


The small claims limit for work-related injury claims is to rise to £2,000 from £1,000. 


This is below the £5,000 limit originally proposed in a recent government consultation paper. However, TUC head of health and safety Hugh Robertson said it was still an attack on the ability of workers to claim compensation and “will disproportionately hit the lowest paid”.


Robertson said raising the limit will restrict the ability of unions to support members. There will also be less pressure on employers from insurers to deal with safety failures that lead to lower level injuries. 


In small claims, a solicitor cannot claim expenses and so any fee for their services would have to come from the award. Raising the limit for personal injury claims to £2,000 will mean that more employees will be unable to recover their costs and will therefore not be able to pursue a legal case.
