Case 2: The facts
A collective agreement at Kulvinder Kaur's workplace stated that there would be no compulsory redundancies. She went to the High Court for a declaration that this gave her the right not to be made compulsorily redundant.
The ruling
The High Court held that the agreement had been incorporated into Kaur's contract and that, even though she also had a contract term that allowed her employer to dismiss her with notice, this did not deny her the right not to be made redundant.
