Statutory sick pay claims

Claims for statutory sick pay (SSP) have to be pursued through the Benefits Agency. Workers cannot pursue the non-payment of SSP as claims for unlawful deductions using Part 11 of the Employment Rights Act 1996. This means SSP claims cannot be taken to employment tribunals.

* The ruling comes from an Employment Appeal Tribunal case, Taylor Gordon & Co v Timmons, 25 September 2003
