Legislation introduces fit note changes

From 1 July 2022, new legislation has been introduced allowing a wider range of healthcare professionals to certify and issue “fit notes”. 


The new Social Security (Medical Evidence) and Statutory Sick Pay (Medical Evidence) (No. 2) Regulations 2022 mean nurses, occupational therapists, pharmacists and physiotherapists are now able to undertake this task. 


The changes apply across England, Scotland and Wales, with similar legislation applying in Northern Ireland.


The “fit note” is the form that provides evidence to an employer about a worker’s absence, as well as providing relevant advice about how to support someone to remain in, or return to, work. 


Until now, only doctors have been able to sign fit notes, and the aim of the new legislation is to reduce pressure on doctors, particularly GPs. 


The Department for Work and Pensions says this will allow patients to see the most relevant healthcare professional and have improved conversations about work and health. 


The change will apply in general practice and hospital settings.


The legislation is permissive, meaning that not every professional in these categories will automatically be required to issue fit notes. 


New training and guidance is planned to help employers and professionals in these healthcare settings identify who may be most suitable for this task.
