Vento bands

The “Vento bands” used as guidance to award compensation for injury to feelings in discrimination cases have been increased for claims issued on or after 6 April 2020. They are now:

• lower band: £900 to £9,000;

• middle band: £9,000 to £27,000; and

• upper band: £27,000 to £45,000, with the possibility of awards over £45,000 being made in exceptional cases.

The changes take account of inflation and a 10% uplift that was applied to personal injury claims in the civil courts that the Court of Appeal in England and Wales said should also apply to employment tribunal claims.

In Scotland, tribunals can decide in individual cases whether to apply the 10% uplift element.
