Holiday pay

An Employment Appeal Tribunal (EAT) ruling means that the only way to ensure that the Working Time Regulations are adhered to is to pay holiday pay at the appropriate rate at the time when the holidays are taken. Employers who pay their employees an additional weekly allowance, which is intended to make up a holiday pay fund, are likely to be in breach of the 1998 regulations, according to a recent EAT ruling.
