Taking claims

Normally, once an applicant has lodged a claim in one court the same issue cannot be pursued in another court. However, where the applicant makes it clear when withdrawing the claim that the intention is to pursue it elsewhere the rule of "estopel" (the legal rule that bars applicants from having the same case heard in different courts) does not apply.
