Bankruptcy and tribunal claims

Employees are barred from taking tribunal claims if they are declared bankrupt. It is up to the trustee in bankruptcy whether or not the employee is allowed to pursue the claim. The trustee can agree to let the employee pursue the claim personally but this agreement has to be reached prior to the tribunal being told that the trustee is withdrawing from the claim.
