Sickness absence and discrimination guide

The TUC has issued a negotiator’s guide on sickness absence and disability discrimination covering current case law and existing good practice.

It says too many employers are breaching the 2010 Equality Act and unions are too often failing to hold them to account for it. This sad statement reflects the reality that the Act, particularly its disability provisions, is very complicated.

Among other issues, unions have reported that employers are continuing to get rid of disabled workers by using their sickness absence, capability or other procedures, without taking due account of the disability.
