Notice for teachers

Teachers generally can only take leave out of school term time. Therefore if employers can end the contract at the end of the school term this effectively deprives the teacher of any holiday entitlement. The EAT in the case of Pass v Wakefield Independent Schools (EAT 385/99) has said that in the absence of an express term, there is an implied right that the contract will not end until after the holiday period.
