Case 3: The facts
Ms Johnson, a psychologist employed by the Prison Service, claimed that she was subjected to discrimination and harassment by other psychologists - one of whom was employed by the Probation Board but was seconded to work at Johnson's prison. A tribunal joined the Probation Board to the proceedings.
The ruling
The Employment Appeal Tribunal held that the Probation Board should not be joined to the proceedings. An individual can only bring proceedings on discrimination in employment against their employer, or someone employed by the same employer.
