Coleman wins hearing on discrimination
The European Court of Justice has said that the Equal Treatment Framework Directive prohibits direct discrimination or harassment of a non-disabled person on grounds of their association with a disabled person.
Legal secretary Sharon Coleman’s complaint was that she had suffered such discrimination because she had a disabled son.
The employment tribunal has at a pre-hearing decided that the Disability Discrimination Act 1995 can be interpreted to give effect to European law.
Ms Coleman’s case will now proceed to a full hearing to decide whether such discrimination in fact took place.
