Rise in small claims limit for whiplash injuries


Unions are opposing the Civil Liability Bill, which was introduced in the House of Lords last month. 


The Bill, which aims to reduce the number and cost of compensation for claims for whiplash injuries, is part of a wider package of government measures that includes secondary legislation to raise the small claims limit for personal injury claims from £1,000 to £2,000. 


Doug Russell, health and safety officer at shopworkers’ union Usdaw, told Workplace Report that while the union’s main focus has been on employer liability claims, it also opposes the changes to road traffic accident (RTA) and whiplash claims as it represents members and their families if they are injured in RTAs. The Bill proposes to raise the small claims limit for whiplash claims to £5,000.
