Redundancy procedure

Case 4: The facts

Told at a meeting with management that his post was redundant, Richard Love claimed unfair dismissal, as there had not been a full hearing with the right to be accompanied and a right of appeal.

The ruling

The Employment Appeal Tribunal said there is no rule giving an employee in a redundancy situation the right to be accompanied, nor any rule that redundancies are unfair without an appeal procedure. Redundancy dismissals are not a matter of discipline, so the rules covering disciplinary hearings are not relevant.
